GUARANTEES & PAYMENT
Standard paint & damp proofing supplier terms of guarantees will apply and be underpinned by Onyx Group 5-year workmanship guarantee in the refurbishment process. The terms of the guarantee will be for the stated guarantee period, commencing on the date of completion of a section of the work and subject to a pro rata deduction of total cost (labour, sundries, transportation & paint) of rectification.
Guarantee Example: For a five- year paint & damp proofing life expectancy: 100% guarantee for the first 12 months followed by a deduction of 25% per annum on the original contract value as per each substrate for the remaining 4 years. Please take note of clause 4 and 5 referencing exclusions and warranty periods.
Where required any paint system failure will be verified and reported by a qualified paint technician or an appointed 3rd party of the paint supplier used.
As per paint supplier terms & conditions; trim work, vanished wood work, epoxy (polyurethane) flooring & free standing walls (E.g. Boundary Walls) are excluded from the guarantee.
IBR sheeting roofs, steel work, wood work, aluminium paint are guaranteed for a 1 year period.
Customer snag-lists are to be issued to Onyx Group within 7 working days from either verbal or written notification by our project manager.
Guarantees and warranties come into effect on full payment of account.
If payment is not received after 7 days of sending the final invoice, Onyx Group rights remain reserved to proceed in legal action and the client will be responsible for legal costs of an attorney and own legal costs.
SITE FACILITIES & ACCESS
Potable water is to be made available (at no extra charge) for use, if required, and will not be wasted or abused.
Power supply is to be made available (at no extra charge) for use, if required, and will not be wasted or abused.
Ablution facilities are to be made available on site for our staff. These will be inspected on a regular basis and be left in the same condition as they were found on commencement of the project. Should such facilities not be available at the client’s site, we may hire such necessary facility in, the cost of which will be for the client’s account.
Lockable storage facilities will be required for our tools and materials whilst work is in progress. Should such facilities not be available at the client’s site, we may hire such necessary facility in, the cost of which will be for the client’s account.
All tools and materials to complete the specified work is included in the price quoted and will be supplied by ourselves.
Unrestricted access must be given to our staff, while we undertake to adhere to any conditions that the client may have i.e. security or safety requirements.
Onyx Group or its appointed agent cannot be held liable for theft or delays beyond our control such as inclement weather, riots, strikes, wars etc.
Onyx Group and staff are covered by a R 3’000’000 public liability insurance policy to provide for any unforeseen damages or claims.
We would like to draw your attention to the fact that during the course of the renovation process some adjoining plants and/or flowerbeds may be slightly spoilt. We do endeavour to minimize these types of damages, but reserve the right that this may occur and may not be found liable for the replacement or compensation of such damages.
